Congress to Review CARB Clean Air Rule Waivers – What It Means for Counties

The EPA has sent three California Air Resources Board (CARB) Clean Air Act rule waivers to Congress for review under the Congressional Review Act (CRA). If Congress rejects them, CARB won’t be able to enforce the related regulations:

  • Advanced Clean Trucks (ACT) – Requires manufacturers to sell more zero-emission medium- and heavy-duty trucks.
  • Advanced Clean Cars II (ACC II) – Sets stricter emissions rules for passenger vehicles.
  • Omnibus NOx Regulations – Reduces nitrogen oxide emissions from trucks.

The ACT rule matters most to counties because it ties into CARB’s Advanced Clean Fleets (ACF) rule, which mandates local governments buy ZEVs when replacing fleet vehicles. However, with ZEV manufacturers struggling and demand slowing, overturning the ACT rule could leave counties without the required vehicles.

CSAC is closely monitoring the situation and will continue advocating for counties.
