Court Denies Efforts to Block New Enforcement of Intoxicating Hemp Regulations

Last Friday, Los Angeles County Superior Court Judge Stephen Goorvitch denied a request to block enforcement of emergency regulations issued last month by the California Department of Public Health to ban THC-containing hemp products. As a result, the ban will remain in effect while the U.S. Hemp Roundtable explores legal avenues to challenge the new regulations.

The new regulations, which the Office of Administrative Law approved on September 23, require that industrial hemp food, food additives, beverages, and dietary supplements intended for human consumption have no detectable THC per serving cannot be sold to purchasers under age 21, and may have no more than five servings per package. Products that combine CBD and THC will continue to remain for sale at cannabis dispensaries.
