Please be advised that the Department of State Hospitals (DSH)
has issued a Departmental Letter that provides updated
information regarding diversion program participants that are
eligible for DSH program funding after the enactment of Senate
Bill (SB) 1323. This Letter supersedes Department Letter
22-001.
Per the Letter,
SB 1323 (Chapter 646, Statutes of 2024), modifies incompetent
to stand trial (IST) procedures as it relates to available
treatment option for felony IST defendants when a court finds
that it is not in the interest of justice to restore the
individual to competency.
This Departmental Letter will also be published on the DSH
