This case tests the standard for what a plaintiff must show to hold a county liable for an employee’s conduct under so-called “Monell” liability. CSAC’s brief urges the United States Supreme Court to consider this case because the standard used by the Ninth Circuit in this case is so minimal that it would greatly increase potential liability for isolated employee conduct rather than a demonstrated pattern of custom and practice, as the courts have previously held.
