The California Supreme Court will decide what standard of judicial review applies to a facial constitutional challenge to inclusionary housing ordinances that require set asides or in-lieu fees as a condition of approving a development permit. CSAC has filed a brief in support of the City of San Jose arguing that the most deferential standard applies to courts’ review of inclusionary zoning ordinances.
