City and County of San Francisco v. Daugherty (A145863)
This case addresses how the timelines interact with the Police Officer Bill of Rights (POBE) interact with other activities that may, by necessity, delay the ability of a law enforcement agency to take action under POBR. In the case, the police department was prevented from initiating disciplinary proceedings against an officer because the department was cooperating with federal authorities in an investigation that required confidentiality. Once the federal investigation concluded, the department initiated discipline, but the trial court determined that time for discipline had already lapsed.
