This case raises an important CEQA issue: What is the burden that a CEQA petitioner must overcome to successfully challenge a lead agency’s decision to adopt a mitigated negative declaration (MND) for a project that the agency determines will not result in any significant unavoidable impacts? CSAC’s brief argues that the trial court improperly admitted lay testimony of evidence of project impacts, and erroneously excused the CEQA petitioners from its burden of demonstrating the potential inadequacy of mitigation measures and environmental regulations identified to mitigate or avoid a project’s potentially significant impacts.
