Gajanan v. City and County of San Francisco (A168328)
This case involves proper application of the “private attorney general” statute, Code of Civil Procedure section 1021.5, to an award of attorneys’ fees in litigation involving proper application of the tax code. CSAC’s amicus brief argues that the trial court misapplied the statute in awarding fees to a plaintiff that did not demonstrate that their lawsuit served an important public interest or benefit the general public.
