This case presents the issue of what judicial review or remedies should be available for a candidate for municipal elected office whose nominating petition submitted at the close of the statutory deadline is found to have insufficient verified voter signatures to qualify for the election. CSAC’s brief, drafted by its Associate Counsel Joel Ellinwood, argues that given the short time between candidate filing deadlines for local elected offices and pre-election deadlines for publication and mailing of sample ballots and voter information guides including all election contests, courts should not allow consideration of extrinsic evidence in signature verification or post-verification judicial review, as it would have adverse impact on the efficient, timely and orderly conduct of elections.
