CSAC has filed a brief in this land use case urging the Court to uphold the longstanding rule that an applicant for a project waives their right to challenge the project’s permit conditions by subsequently executing and recording deed restrictions recognizing the existence of the conditions and constructing the project as approved.  CSAC’s brief was drafted by its Associate Counsel Janis Herbstman.
