This case will interpret Penal Code section 1305.4;  specifically, whether an order to extend application to extend the 185-day period allowed under Penal Code section 1305 an additional 180-days runs from the date the 185-day period expires or the date the motion is heard.  The surety in this case argues the latter, which effectively gives them more than an additional 180 days to return the criminal defendant.  CSAC’s brief in support of Tulare County was drafted by the County Counsels’ Association 2015 Summer Law Clerk, Samantha Huynh.
