The pharmaceutical industry has appealed a district court ruling upholding against a Commerce Clause challenge Alameda County’s “Safe Drug Disposal” ordinance, requiring producers of prescription drugs to fund or operate “take back” programs in the county if their drugs are sold there.  CSAC filed a brief in support of the County in the Ninth Circuit.
