Sheetz v. County of El Dorado (C093682)
This case addresses whether, to the extent impact mitigation fees are subject to the Nollan/Dolan takings analysis, adopting such fees under the standards of California’s Mitigation Fee Act meets the Nollan/Dolan requirements. CSAC’s brief, drafted by Kristen Jensen and Austin Yang in the San Francisco City Attorney’s Office, argues that the Mitigation Fee Act already requires rough proportionality, and therefore El Dorado County’s fees should be upheld.
