In this case, the California Supreme Court will consider whether all public entities are exempt from the obligations in the Labor Code regarding meal and rest breaks, overtime, and payroll records, or only those public entities that satisfy the “hallmarks of sovereignty” standard adopted by the Court of Appeal in this case. CSAC’s amicus brief informs the Court about the myriad of special districts, JPA’s, etc. that carry out local government functions, and that the “hallmarks of sovereignty” test unnecessarily constrains flexibility and creativity in providing services at the local level.
