Whitehead v. City of Oakland (S284303)
The California Supreme Court in this case will be considering whether a liability release agreement between a bicyclist and the organizer of a recreational bicycle ride extends to the alleged negligent maintenance of a public road by a municipality named in the agreement but not a party to it. CSAC’s amicus brief, drafted by its Associate Counsel Joel Ellinwood, argues that such waivers are lawful under the Civil Code and support important public policy considerations, including continued use of public roads for organized recreational purposes.
